Fisher & Phillips Attorneys Among Atlanta’s ‘Legal Elite’

D. Albert “Bert” Brannen, managing partner of the Atlanta office of Fisher & Phillips LLP, and Tex McIver, partner with the firm, have been named to Georgia Trend magazine’s Legal Elite. Both attorneys were recognized for their work in labor and employment law.

In its 11th year, the Legal Elite is a listing of Georgia’s top attorneys as selected by their peers. Any attorney who is a member of the state bar and lives and practices in Georgia is eligible to vote and/or be voted onto the list.

Since 1982, Brannen has represented employers exclusively in solving labor and employment law problems in the workplace. He counsels employers about how to avoid workplace crises, comply with all applicable laws and prevent litigation. He also spends a significant amount of his time advising employers on union-related matters and in assisting employers with the administration, negotiation, mediation and arbitration of collective bargaining agreements.

Brannen is active in the State Bar of Georgia and has served as Chairman of the Bar’s Labor and Employment Law Section. He is a past member of the Board for the Georgia Branch of the Associated General Contractors (AGC) and is immediate past chair of AGC’s national Labor & Employment Law Council. Brannen is a member of the Society of Human Resources Management, Human Resources Leadership Foundation (HRLF), Electric Cooperative Bar Association, Georgia Tech Bar Association, Georgia Association of Manufacturers, Lawyers Club of Atlanta and other professional groups. He also teaches a class on labor and employment law at Georgia Institute of Technology, where he received an undergraduate degree. He received an MBA and law degree at the University of Georgia with honors. 

In addition to this year, Brannen was recognized as a member of Georgia’s Legal Elite in 2009. He also has been included in Georgia Super Lawyers since 2005, The Best Lawyers in America since 2010 and a 2013 Top Rated Lawyer in Labor & Employment by Martindale-Hubbell™.

In his 40-year career, McIver has assisted clients nationally and internationally in their compliance efforts involving all federal and state employment laws. He advises employers concerning mergers and acquisitions, consolidation and streamlining of organizations. McIver has successfully defended employers in more than 200 union organizing campaigns and regularly handles contract negotiations, arbitrations, defense of corporate campaigns and the full range of strikes, lockouts and other interruptions of work.

McIver was selected by Atlanta Lawyer magazine as one of the "top legal minds" in the city, has been listed in Who's Who Legal USA -- Management Labour & Employment by the researchers at the International Who's Who Legal publication, is "AV" Peer Review Rated by Martindale-Hubbell and has been repeatedly selected for inclusion in Georgia Super Lawyers. He has been listed in Chambers USA, America's Leading Business Lawyers since 2007 and in The Best Lawyers in America since 2006. 

In addition to this year’s honors, McIver was named one of Georgia Trend magazine's Legal Elite in 2010 and 2011. He also was selected as a Client Service All-Star for 2011, an elite group of attorneys nominated by in-house counsel for their outstanding client service.

In 2012, McIver was appointed by the Georgia Attorney General to serve as Special Assistant Attorney General representing Gov. Nathan Deal and the State in the matter of Coleman et al. v Deal and Jackson. He was awarded the 2012 Highest Effort Award from Sigma Alpha Epsilon fraternity for his achievement in the field of law. Earlier this year, the fraternity honored him with The Order of the Lion Award, the third-highest award a member can receive, for his service in helping to establish an SAE chapter at Georgia College and State University in Milledgeville, Ga. 

Before entering private practice, McIver served as a captain in the U.S. Air Force Judge Advocate General Department from 1968 to 1972. During that time, he was awarded the U.S. Air Force Meritorious Service Medal for his recognition as a trial lawyer and then, in 1971, the Bronze Star Medal for combat-related service in Republic of South Vietnam.

McIver received a bachelor’s degree from Texas Christian University and a law degree from the University of Texas School of Law.
