Police Arrest Wanted Midtown Burglary Suspect

Atlanta police also looking for a trio of gunmen who robbed two men in the parking lot of the Ponce de Leon Kroger late Thursday evening.

Atlanta Police arrested a perpetrator in Midtown earlier this month who was wanted in connection with a 2009 burglary in the Midtown neighborhood.

Tracy Foster, 42, was apprehended on July 1 while attempting to burglarize an undisclosed sub shop.

Foster is currently in the Fulton County Jail booked on 20 criminal charges, including 9 counts of commercial burglary for businesses in Buckhead.

In late May, Atlanta police requested assistance from the public in locating Foster for his alleged part in the Midtown neighborhood burglary from three years back. Also in 2009, Foster was arrested by the APD Burglary Unit for a separate incident, and was sentenced to five years in prison.

In January of this year he was paroled from his latest prison stay as the full sentence ran until 2014. He has been incarcerated several times in the last 20 years and after his arrest this month, bond was set at $45,000.

Elsewhere, Atlanta police are looking for a trio of gunmen who robbed two men in the parking lot of the Kroger at 725 Ponce de Leon Ave. late Thursday evening.

The victims, who were with two witnesses, told police they parked in the lot around 11 p.m. They were walking to the Masquerade at 695 North Ave. when they were approached by two gunmen in the rear of the Kroger parking lot, nearer to the North Avenue entrance by the truck loading docks.

One of the gunmen approached the two victims and began asking a series of questions according to the report.

They asked the victims where they were from and if they had any money.

As the victims began walking away, the two gunmen — each armed with a handgun — pulled their revolvers grabbed one of the female witnesses and demanded money.

The two victims handed over their wallets and mobile phones.

At that point, a third robber pulled up in an orange-colored Honda Passport and drove off with the two gunmen, heading east on North Avenue.

That part of the Kroger lot had no cameras so there are no images of the suspects, but the victims and witnesses gave the following descriptions:

  • Suspect No. 1 — A black male approximately 15 years of age, wearing a yellow t-shirt and armed with a handgun.
  • Suspect No. 2 — A black male approximately 28 years of age, wearing a white shirt, red and black shorts, a red Atlanta Braves hat, and also armed with a handgun.
  • Suspect No. 3 — A black male driving an orange Honda Passport.

Anyone with any information is urged to call 911 or Crime Stoppers Atlanta at 404.577.TIPS (8477).

Marc, not young anymore. Obviously this guy is a carrier criminal. There is no reason to keep releasing him back out into the streets to commit more crimes.

We wrote about him on the MPSA website when the warrant was first issued... http://www.midtownponce.org/p3406.html

Thanks Steve. I remember reading about him on your site. So since he has such an extensive criminal record, and has already served time for burglary, would this mean he would get a much longer sentence this time around?
Steve Gower July 14, 2012 at 01:05 AM
You would think that means prison time, but Fulton County has a tendency to tack on more probation to run concurrently with existing probation. This guy is on parole, so there should be some more leverage but only until the existing sentence expires. In other words, back to prison on an existing sentence, and then perhaps another sentence from Fulton County running concurrently with that one. That has been our experience over the years.

Never will change, until we, the citizens decide to be proactive and defend ourselves!!!

The perp is 45 years old, not 42. From Steve's link: ■Warrant number EW059567, DOB 7/7/1967, Full name Tracy Dean Foster Internal note: explicit instructions from police contacts to include DOB

Jeff, I saw that at the MPSA website yesterday and it very well could be correct. I went with the information that the APD provided me with yesterday. Fulton County Jail records do not provide a DOB.
Steve Gower July 15, 2012 at 09:19 AM
@Jeff & Hunt - I am the one that puts together MPSA content. That line was a copy & paste job directly from an email from APD. The Department of Corrections lists a 1967 DOB, and his entry at the Parole Board website shows a current age of 45.

Thanks Steve, looks like APD info provided to me may have been incorrect. Regardless of this man's age, I think we can all agree that we're glad he's off Midtown's streets and hope he will remain so for a long time.
